This article details an important change in employment law for situations involving negligent hiring and retention of employees. Developing theories of law in many jurisdictions hold employers liability for negligent hiring or retention when employers knew, or should have known that the employee was incompetent, violent or dangerous. The author discusses cases finding employers liable where an employee commits an intentional tort almost invariably outside the scope of employment, against a customer or the general public where the employer knew, or should have known of the employee’s background. The author concludes that employers should respond to such cases with increased care and investigation in the hiring stage of employment so as to avoid such charges.
