Abstract

This article considers the legality of voluntary affirmative action plans in both the public and private sectors. The author reviews Supreme Court precedent in this area, and contrasts the holdings in order to harmonize the decisions and gain insight as to which aspects of the plans may be impermissible, and thus trigger charges of reverse discrimination. Citing the need and desirability of a diverse workforce, the author offers the Weber case as a model for achieving this end.
