Abstract
This article reviews the law relating to the ability of employers to refuse to hire job applicants who are also outside union organizers (commonly known as ‘salts’). Typically, unions employ a strategy of ‘salting’ the workforces of companies they have targeted for unionization drives, and the author leaves it to the readers to decide whether this is a fair organizing tactic or a nefarious strategy. The author suggests that developing case law will provide guidance to employers regarding viable organizing efforts by unions.
